  1. This is an appeal by the 3 Appellants before the Leeds Employment Tribunal against parts of that Employment Tribunal's decision promulgated on 2 November 1999, which upheld the Respondent, Ms Habashi's claims in part.
  2. On 6 March 2000, solicitors acting for the first Appellant faxed this Employment Tribunal to indicate that the first Appellant, Bradford Racial Equality Council, had withdrawn their Notice of Appeal. In these circumstances we shall dismiss that appeal. As to the remaining 2 named Appellant's, Saleem Sharif and Shtiaq Ahmed, a further fax received on 10 March from their solicitors indicated that the solicitors had been unable to obtain instructions from either of the individual Appellant's in respect of the withdrawal of their appeals, and indeed, the third Appellant, Mr Ahmed is, we are told, presently, in Pakistan. In these circumstances an application has been made for a stay in these proceedings pending receipt of instructions from those Appellant's by those solicitor's.
  3. The order we will make in relation to the second and third Appellant's is this: their appeals will stand dismissed unless, within 28 days of the promulgation of this order, they notify the Employment Appeal Tribunal that they or either of them wishes to proceed with their appeals. In the event of such notification their case will be relisted for a preliminary hearing.
