    MR RECORDER BURKE QC:

  1. We heard this appeal and cross appeal, as a matter of urgency, on 9 March 2001. It was apparent, at the conclusion of the argument, that we would need to take time to consider our judgment, as indeed the parties expected. However a directions hearing, the holding or course of which may be affected by the outcome of this appeal, has been fixed by the Employment Tribunal for tomorrow, 13 March; and the parties were anxious to have our decision, if possible, today. Accordingly we offered to endeavour to reach and give a decision by today, 12 March, while reserving the reasons for our decision to be handed down later; the parties agreed that we should proceed in that way.
  2. We have reached a decision on the appeal and the cross appeal; our decision is that the appeal and cross appeal are dismissed. The reasons for our decision will be handed down at a later date; the parties will of course be informed in advance of that date.
