  1. It seems to us that the matter raised by Ms McKie in her Notice of Appeal at paragraph 6.1 clearly raised a seriously arguable point of law and that accordingly we should allow the appeal to go forward on that ground.
  2. It seems to us on the other hand that paragraph 6.2, raising the perversity argument, adds nothing to what is in ground 6.1 and in those circumstances we think that that should be struck out of the Notice of Appeal. We understand that Ms McKie agrees with that course.
  3. Directions. Listing Category B. Skeleton Arguments together with copies of authorities not less than 14 days before the hearing.
