  1. This is a Preliminary Hearing of an appeal by Industrial Services Group Ltd ('the Appellant') from a decision of the Employment Tribunal sitting at Carlisle on 11-13 June 2001, deliberations on 6 August, the decision was promulgated on 31 August 2001.
  2. Among the issues between the parties was: was there a transfer of undertakings defined in the Transfer of Undertaking (Protection of Employment) Regulations 1981 between the first and second Respondents.
  3. Mr Brown who appears before us this morning appears for the first Respondent, as he did below, when a solicitor appeared for the second Respondent.
  4. We have been satisfied, after some questioning of Mr Brown and having considered his Skeleton Argument, the Extended Reasons and the Notice of Appeal that then is an arguable case to go forward.
  5. Category B, estimate 1 day. We trust that 1 day includes sufficient time for the Tribunal to give judgment, that day if the members so wish.
