Garman Glyn Roberts v (1) Frederick John Shore (2) Elizabeth Dilys Shore (Adverse possession : Factual possession) [2018] UKFTT 50 (PC) (20 December 2017)


Application to rectify the register by removing a strip of land from Respondents’ title and adding it to Applicant’s. On extensive consideration of the pre-registration title held that there was no mistake in the register; alternatively that there had been a boundary agreement that the land belonged to Respondent; alternatively that, if they did not have paper title, the Respondents would have acquired title by adverse possession by 2001.
