Decision: The appeal is struck out.
REASONS
- An order dated 16 August 2024 directed the appellant to send to the tribunal by 6 September 2024 either:
a. A copy of the review carried out by the Pensions Regulator, or
b. A copy of the letter from the Pensions Regulator refusing to carry out a review.
- The order dated 16 August 2024 included notice to the appellant that failure to comply with the above directions would automatically lead to the striking out of the proceedings under rule 8(1) of The Tribunal Procedure (First-tier Tribunal)(General Regulatory Chamber) Rules 2009 (the Rules) and that by 6 September 2024 the appellant must complete and return to the tribunal the 'Pensions – right of appeal' form attached to the order dated 16 August 2024.
- The appellant has failed to comply with the directions issued on 16 August 2024.
- The proceedings are struck out under rule 8(1) of the Rules which stated that proceedings would be automatically struck out if the appellant has failed to comply with a direction that stated that failure by the appellant to comply with the direction would lead to the striking out of the proceedings.
- The appellant has failed to comply with the directions dated 16 August 2024 and, accordingly, the appeal is struck out.
