Decision notes [2018] UKFTT 613 (PC). Application for adverse possession of a unregistered yard and driveway leading into Applicants’ business premises. It had been gated since around 1990 and Applicants claimed to have the only keys. Various neighbours alleged that they had enjoyed access to the disputed land and that they had been given keys to the gate by Applicants’ predecessors in title. They denied that Applicants had been in exclusive factual possession. Their evidence was rejected and the application was given effect to.
