Decision notes | [2018] UKFTT 718 (PC). Applicants applied to cancel a caution lodged by Respondent to protect an alleged loan granted to them. Respondent had been made bankrupt in March 2012 but the Tribunal was only notified of this the day before the hearing. The trustee in bankruptcy had made it clear that he had no interest in maintaining the caution. As the Applicants had come to court and were prepared for a hearing, the evidence was heard. HELD that in any event the Applicants had never entered into a loan agreement or charge with Respondent. |
