Summary: The complainant requested to be provided with certain copies of legal advice obtained by the public authority. The public authority declined relying upon an exemption under section 42 of the Freedom of Information Act (-section 42-) claiming legal professional privilege and that the public interest in maintaining the exemption outweighed the public interest in disclosing the information. The Commissioner has considered the public authority-s file and the legal advice in question as a result of which he is satisfied that the public authority has properly applied section 42.
