Summary: The complainant requested a copy of the original index for a file created by the Commission for Health relating to a complaint against an NHS Trust. The Healthcare Commission provided a typewritten file index which had been created in response to an earlier request for information, but maintained that no original index existed. During the course of his investigation the Commissioner sought information about the records management policies of the Healthcare Commission but was unable to determine with any certainty whether or not the information was held, and is therefore unable to conclude that there has been a breach of section 1 of the Act.
