Summary: The complainant requested full names and addresses of tenant and independent members who sat on the Council's Shadow Housing Board (SHB); previously the council had provided o everybody then appointed to sit on its SHB. However, the council did not provide addresses, arguing that the information was exempt under section 40(2) (personal data). As part of his investigations the Commissioner also considered whether there was an obligation to state the addresses requested on a public register, but the Commissioner has concluded from his enquiries that no such obligation exists. The Commissioner's decision is that the information was personal data about third parties and that to disclose the information would contravene the first data protection principle. The information was therefore exempt under section 40 of the Act.
