Summary: The complainant requested a copy of a safety audit conducted on MK Airlines by the public authority. The public authority identified the request as constituting two reports on a number of on-site inspections which were conducted prior and subsequent to granting MK Airlines an Air Operator Certificate in 2006. It however withheld both reports by virtue of the exemption at section 31(1)(g) and by extension sub section (2)(d) of the Act. The Commissioner finds that the exemption was not engaged and has ordered the disclosure of both reports. He also finds the public authority in breach of sections 1(1)(b) and 10(1) of the Act. Information Tribunal appeal EA/2009/0033 part allowed.
