The Council refused to disclose the information under section 40(2) of the Act -˜personal data-™ and section 41 -˜Information Provided in Confidence-™. The Commissioner has investigated and found that the requested information is not personal data, and that therefore section 40(2) is not engaged. He also found that section 41 is not engaged. Therefore he requires that the withheld information be released.
