Summary: The complainant requested information from South Kesteven District Council (the Council) relating to the termination of contract of the Chief Executive. The Council withheld this information on the grounds that section 40(2) of the Act applied; in that the information requested constituted the Chief Executive-™s personal data and to release it would be unfair to him. The Commissioner is satisfied that the Council was correct to apply the exemption in this case; he does not therefore require the Council to take any further steps in respect of this request.
