Summary: The complainant requested copies of Mandatory Occurrence Reports (MOR) by XL Airways in the 12 months before they went out of business. The Public Authority relied on section 44 of the Freedom of Information Act 2000 (FOIA) to withhold the information. The Public Authority cited section 23 of the Civil Aviation Act 1982 as the relevant statutory bar on disclosure which informed their reliance on section 44 of the Act. After considering the case the Commissioner upholds the Public Authority-™s decision to withhold the information under section 44 of the Act. The Commissioner does not require the Public Authority to take any further steps in relation to the complainant-™s request.
