Summary: The complainant requested information in respect of the development of Victoria Dock, Caernarfon. The Council originally refused the request on the basis of section 43 of the Act. During the course of the Commissioner-™s investigation the Council reconsidered the request under the provisions of the EIR and refused to disclose the requested information, citing regulations 12(5)(e) and 12(5)(f). The Commissioner finds that neither exception is engaged and requires the Council to disclose the withheld information. He also found a number of procedural breaches of the EIR.
