Summary: The complainant submitted a request to the London Borough of Bromley Council (-˜the Council-™) for information from environmental records held on a property in Beckenham. The Council refused to provide some of the information in the complainant-™s preferred format of inspection, and stated that a charge would be levied to cover the costs of compiling the information into an alternative format. During the course of the Commissioner-™s investigation, the Council confirmed that some of the requested information was not held, and agreed to provide the remainder of the information for inspection free of charge. The Commissioner finds that the Council breached regulation 5(2) by failing to make the requested information that it held available within the statutory time for compliance. He also finds that in relation to the information that is not held, the Council has breached regulation 14(2) by failing to provide a refusal notice within 20 working days, and regulation14(3)(a) by failing to cite the specific exception it relied upon in refusing the request. It has also breached regulation 14(5) by failing to inform the complainant of both his right to seek an internal review and of the enforcement and appeal provisions of the EIR. He does not require the Council to take any further action.
