Summary: The Complainant requested information in relation to cases which had been referred to the -˜Clearing House-™ within the MOJ by various government departments. Some of the information was released to the complainant during the course of the Commissioner-™s investigation. The Commissioner considers the MOJ was correct to apply section 42(1) to the legal information in this case. However the Commissioner-™s decision is that the MOJ was not correct to apply section 36(2)(b) and (c) to the remaining withheld information and it was thus in breach of section 1(1)(b) and section 10 of the Act. The Commissioner also finds that the MOJ in breach of sections 17(1)(b) and (c) and 17(3).
