Attorney Generals Office (Decision Notice) [2010] UKICO FS50157702 (22 March 2010)

Summary: The complainant made a request to the Attorney General-™s Office for information concerning the Legal Services Bill and the Joint Committee-™s recommendations 26 and 29. In particular the complainant was looking for information relating to the regulation of lawyers and the exemption for government lawyers from paying practising fees. The Attorney General-™s Office refused to disclose the requested information citing the exemption at section 35(1)(a) of the Act. The Commissioner found that the exemption at section 35(1)(a) was engaged and that the public interest in maintaining the exemption outweighed the public interest in disclosing the information. The Commissioner therefore found that the Attorney General-™s Office had acted correctly in withholding the information. Information Tribunal appeal number EA/2010/0080 part-allowed.
Section of Act/EIR & Finding: FOI 35 - Complaint Not upheld
