Cabinet Office (Decision Notice) [2010] UKICO FS50209723 (21 June 2010)

Summary: The complainant requested information from the Cabinet Office about progress with a suggested new facility for the Government-™s e-petitions website. Initially, the Cabinet Office stated no information relevant to the request was held. Subsequently, the public authority reviewed its position and stated information was held, made up of a request for legal advice, an outline accompanying the request and the resulting legal advice. The Cabinet Office provided the outline but withheld the request for legal advice and the advice as exempt information under section 42 of the Act. The Commissioner has investigated and found the request for legal advice and the advice were the only information held relevant to the information request that had not been disclosed. Furthermore the Commissioner is satisfied, having reviewed the balance of the public interest, that the requested information would be exempt by virtue of section 42(1) of the Act.
