Summary: The complainant requested information held by the Police Service of Northern Ireland (the PSNI) relating to the Smithwick Tribunal. The PSNI refused to disclose the information and cited sections 23(1)(a) and (b), section 24, section 27(1) and 27(2), section 30(1)(a), (b) and (c), section 31(1), (a), (b) and (c), section 36(2)(b)(i) and (ii), section 36(2)(c), 38(1)(a) and (b), section 40, section 41(1)(a) and (b), and section 42(1). The Commissioner is satisfied that section 23 applies to some of the withheld information and 27(1)(a) applies to all of the remaining information and that the public interest in favour of maintaining the exemption outweighs the public interest in favour of disclosing the information. The Commissioner also found a number of procedural breaches in relation to the PSNI-™s handling of the request.
