Summary: The complainant made a request for information about two police officers serving within Essex Police (the -public authority-). The information was withheld under the exemption in section 40(2) (personal information) of the Freedom of Information Act 2000 (the -Act-). The Commissioner-s decision is that the exemption at section 40(2) is engaged but that disclosure would not breach any of the principles in the Data Protection Act 1998 (the -DPA-). The complaint is upheld. The Commissioner further finds that the public authority breached sections 1(1)(b) and 10(1) in failing to disclose the withheld information.
