Summary: The complainant requested information from Craven District Council relating to a compromise agreement between the Council and the outgoing Chief Executive Officer. The Council withheld this information on the grounds that section 40(2) of the Freedom of Information Act applied in that the information requested constituted the Chief Executive-™s personal data and to release it would breach the Data Protection Act. The Commissioner has investigated and is satisfied that the information is personal data and that disclosure would contravene the first data protection principle and therefore section 40(2) is engaged. He requires no remedial steps to be taken by the public authority. Information Tribunal appeal number EA/2010/0095 part-allowed.
