Cheshire Constabulary (Decision Notice) [2010] UKICO FS50271742 (06 October 2010)

Summary: The complainant requested video footage taken from the mobile phones of three defendants who were convicted, in 2008, of the murder of Garry Newlove. Cheshire Police originally applied sections 44 (prohibitions on disclosure), 40(2) (personal data), 30(1) (investigations and proceedings) and 31(1) (law enforcement). As the Commissioner has decided that the information requested is exempt from disclosure under section 40(2) of the Act he has not considered the other exemptions. He requires no remedial steps to be taken in this case.
