Summary: The complainant requested details of any complaints submitted about enforcing officers at the Isle of Wight Council (the -Council-) who issue fixed penalty notices. In view of the history and context of the request, the Council believed the request to be vexatious and therefore claimed that section 14(1) of the Freedom of Information Act 2000 applied. The Commissioner has considered the case and is of the view that the issue of vexatiousness is not clear-cut. However, on balance, the Commissioner has decided that section 14(1) was applied correctly. Information Tribunal appeal number EA/2010/0171 dismissed.
