Summary: The complainant requested information relating to consultants employed within the Council-™s Education Service Area during the financial year 2008/2009. The Council refused to provide the information requested by virtue of section 43 of the Act. During the course of the Commissioner-™s investigation the Council also sought to rely on the exemption contained at section 40(2) of the Act. The Commissioner has investigated and found that sections 43(2) and 40(2) are not engaged and accordingly has ordered the release of the information. The Commissioner has also identified a number of procedural shortcomings in the way the Council handled the complainant-™s request.
