Surrey Police (Decision Notice) [2010] UKICO FS50284940 (22 November 2010)

Summary: The complainant requested the prosecution thresholds for speeding vehicles in Surrey as compared to ACPO (Association of Chief Police Officers) guidelines. Surrey Police confirmed it holds the requested information but refused to provide it on the basis that it was exempt from disclosure by virtue of sections 31 (law enforcement) and 38 (health and safety). The Commissioner-™s decision is that section 31 is engaged and that the public interest in maintaining the exemption outweighs the public interest in disclosure. As a result of this finding, he has not considered the exemption in section 38. The Commissioner found procedural breaches in the handling of the request.
