Summary: The complainant requested a copy of report into flooring defects at Ysbyty Cwm Rhondda. The public authority refused the request by virtue of section 43 of the Act. During the Commissioner-™s investigation the public authority also sought to rely on section 36 of the Act. The Commissioner has investigated and concluded that section 43 is not engaged in respect of the requested information and he has not accepted the late application of section 36. Accordingly, the Commissioner has ordered disclosure of the information. The Commissioner has also identified a number of procedural shortcomings in the way the Board handled the complainant-™s request.
