Summary: The complainant requested the Administrators-™ reports into the Presbyterian Mutual Society, which was placed in administration in November 2008. DETI refused to disclose the information, relying upon the exemptions set out in sections 31(1)(g) and (h) and 40(2) of the Freedom of Information Act 2000 (the Act). The Commissioner finds that the exemption in section 31(1)(g) is engaged in relation to the entirety of the withheld information, and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information. The Commissioner requires no steps to be taken. However, the public authority breached its procedural obligations under the Act by failing to issue its refusal notice within 20 working days.
