Summary: The complainant made a request to the Governing Body of Somerset Bridge Primary School (-the School-) for a copy of its maintenance and service records for its septic tank(s), sewage pipes and wells for a defined period of time. The School withheld this information under regulation 12(5)(b) on the basis that its disclosure would adversely affect the ability of a local council to carry out a criminal investigation related to contracts for the maintenance of those services. The Commissioner has decided that the School was entitled to withhold the requested information under regulation 12(5)(b). However he has determined that the School breached a number of procedural aspects of the Environmental Information Regulations in its handling of the request. Information Tribunal appeal EA/2011/0117 withdrawn.
