Summary: The complainant made a request for information to Yaxley Parish Council (-the Council-) on 9 February 2010. The Council refused to comply with the request on the grounds that it considered it to be vexatious under section 14 of the Freedom of Information Act 2000 (-the Act-). The Commissioner investigated and found that requested information was environmental and should have been considered under the Environmental Information Regulations 2004 (EIR), and as such the correct exception should have been 12(4)(b). The Commissioner finds that the Council did not provide sufficient evidence for 12(4)(b) to be engaged.
