Summary: The complainant requested copies of the interview notes taken by the panel when they interviewed prospective candidates for the vacancy of Information Commissioner. The Ministry of Justice (MoJ) confirmed it held the requested information but refused to provide it on the basis that it was exempt from disclosure by virtue of section 40(2) (personal data). The Commissioner has decided that the MoJ was correct to withhold the information as disclosure would breach the first data protection principle.
