Summary: The complainant requested a copy of the current Trust risk register and associated risk management plan as held by Warrington and Halton Hospitals NHS Foundation Trust (the Trust). The Trust has disclosed the risk management plan but withheld the risk register citing section 36(2)(b)(ii) of the Act. The Commissioner finds that that the exemption under section 36(2)(b)(ii) was engaged but decided that the public interest in maintaining the exemption did not outweigh the public interest in favour of disclosing the information. The Commissioner also recorded a number of procedural breaches in relation to the Trust-™s handling of this request.
