Royal Mail (Decision Notice) [2011] UKICO FS50318446 (06 January 2011)

Summary: The complainant made a request to Royal Mail Group PLC (the -Royal Mail-) under the Freedom of Information Act 2000 (the -Act-) for information regarding how much undeliverable mail was sent for disposal by the National Returns Centre in each financial year from 2004/2005 to 2009/2010. The Royal Mail confirmed that it held part of the requested information but stated that some of this information was exempt from disclosure by virtue of section 43(2) of the Act. The Commissioner has concluded that section 43(2) is not engaged and that the information requested should be disclosed. As a consequence Royal Mail breached section 1(1)(b) and section 10(1). However, the Commissioner finds that, on the balance of probabilities, Royal Mail does not hold information relating to part of the complainant-s request.
