Summary: The complainant made a request to Capital for Enterprise Limited (CfEL) for information relating to Enterprise Capital Funds (ECFs). CfEL refused to provide this information to the complainant as it stated it was exempt from disclosure under section 41 and section 43(2) of the Freedom of Information Act 2000 (the -Act-). The Commissioner considers that the section 43(2) exemption was correctly engaged in this case. The Commissioner did not therefore go on to consider CfEL-s application of section 41.
