Summary: The complainant asked Her Majesty-s Courts Service (the -public authority-) to provide information relating to the job interview of a third party. The public authority refused to disclose this using the exemption under sections 40(2) of the Freedom of Information Act 2000 (the -Act-). The Commissioner considers that section 40(2) by virtue of 40(3)(a)(i) was correctly applied in this case and that disclosure would breach the Data Protection Act 1998 (the -DPA-). The Commissioner requires no steps to be taken. The complaint is not upheld. The public authority-s handling of the request also resulted in breaches of certain procedural requirements of the Act as identified in this Notice.
