Summary: The complainant requested information from the Ministry of Justice (MoJ) relating to applications made to the Homicide Fund 2010. The MoJ provided some information but withheld the remainder by virtue of the exemptions in sections 40 (personal information) and 43 of the Act (commercial interests). During the course of the Commissioner-™s investigation, it disclosed more of the information but refused to disclose the remainder. The Commissioner-™s decision is that the public authority was entitled to withhold the information by reference to sections 40(2) and 43(2). However, the public authority-™s handling of the request also resulted in breaches of certain procedural requirements of the Act as identified in this Notice.
