Summary: The complainant requested information about the academic and professional qualifications relating to a number of named Council employees. The Council initially refused to provide all of the requested information under section 40(2). In its internal review, the Council provided the information for one of the named individuals, but continued to withhold information relating to other named individuals by virtue of section 40(2). The Commissioner has investigated and determined that the Council correctly applied section 40(2) to the remaining withheld information. In failing to provide the information which was disclosed at the time of the internal review, the Council breached section 10(1) of the Act. The Commissioner does not require any remedial steps to be taken.
