Summary: The complainant submitted a request to the London Borough of Newham (-˜the Council-™) for information submitted to the Council by bidders who had tendered applications for a casino license. The Council withheld this information under sections 44(1)(a) and 43(2) of the Act. The Commissioner has investigated and found that the Council was entitled to rely on section 44 to withhold the requested information in its entirety as disclosure is prohibited by a statutory bar. In light of this he has not gone on to consider the application of section 43. The Commissioner does not require the Council to take any further action.
