Summary: The complainant requested a copy of an INCA report. This is a report detailing the movements of a Police vehicle. It can be retrieved and downloaded from the vehicle in question. The public authority neither confirmed nor denied it held the INCA report on the basis of the exemption at section 30(3) of the Act (investigations and proceedings conducted by public authorities). The Commissioner found that the public authority incorrectly refused to confirm or deny it held the INCA report on the basis of the exemption at sections 30(3). The Commissioner has therefore ordered the public authority to confirm or deny it holds the INCA report in accordance with its duty under section 1(1)(a) of the Act.
