Summary: The complainant made a freedom of information request to the Department of Health for a copy of its strategic risk register. The public authority refused the request under section 35(1)(a) (Formulation and development of government policy) and the complainant appealed the decision to the Commissioner. The Commissioner has now investigated the complaint and found that the section 35(1)(a) exemption is engaged and that the public interest in maintaining the exemption does not outweigh the public interest in disclosure. The Commissioner requires the public authority to disclose the requested information. Information Tribunal appeal number EA/2011/0286 part allowed.
