Summary: The complainant wrote to Bradford Metropolitan District Council (the -council-) and requested information relating to the council-s adoption of Perseverance Street, Wainman Street and Angel Street. The Information Commissioner-s (the -Commissioner-) decision is that the council did not deal with the request for information in accordance with the FOIA in the following way: it wrongly applied section 40(2) of the FOIA to the information specified in the fourth element of the request. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: disclose the withheld information to the complainant.
