Summary: The complainant submitted a request to Devon and Cornwall Police (the Police) asking for the number of times a day a safety camera at a particular location in Cornwall had been activated. The Police refused to provide this information on the basis that it was exempt from disclosure under the law enforcement exemption (section 31) and the health and safety exemption (section 38) of the Freedom of Information Act. The Commissioner-™s decision is that the Police are entitled to withhold this information. This decision notice is currently under appeal to the Information Tribunal.
