Summary: The complainant requested information relating to an area of land owned by Northill Parish Council (-˜the Council-™) adjacent to his property which he has previously attempted to purchase from the Council. The Council has refused to comply with the requests because it considered them to be vexatious under the FOIA and manifestly unreasonable under the EIR. The Commissioner-™s decision is that the Council correctly determined the requests to be manifestly unreasonable. The Commissioner finds the Council in breach of section 17(5) in not providing a refusal notice in accordance with section 10 of the FOIA and in breach of regulation 14 of the EIR. There are no steps to be taken. This decision notice is currently under appeal to the Information Tribunal.
