Cambridgeshire County Council (Decision Notice) [2012] UKICO FS50431297 (27 November 2012)

Summary: The complainant has requested copies of records relating to a dispute between Cambridgeshire County Council (-the Council-) and an external contractor about the completion of the Guided Busway Scheme; a scheme engineered by the Council with the aim of improving public transport services. The Council informed the complainant that part of the requested information was obtainable from the Technology and Construction Court. For the remainder, the Council advised that the information was subject to the exceptions provided by regulations 12(5)(b) (course of justice), 12(5)(d) (confidentiality of proceedings) and 12(5)(f) (voluntary supply) of the EIR. The Commissioner has found that regulation 12(5)(b) of the EIR is engaged and that in all the circumstances of the case the public interest favours the withholding of the information. He does not therefore require any steps to be taken as a result of this notice. This decision notice is currently under appeal to the Information Tribunal.
