Summary: The complainant has requested information relating to the proposed transfer of the family health service functions of primary care trusts in the south west to NHS Shared Business Services. The Commissioner-s decision is that NHS Wiltshire (-the Trust-) has incorrectly applied the exemption provided by section 43 (commercial interests) of FOIA to the contents of two documents covered by the request. The Commissioner requires the public authority to disclose the documents with the exception of any names and contact details included in the information that the Trust considers are subject to section 40(2) (third party personal data) of FOIA.
