Summary: The complainant requested information from the Compensation Agency relating to a claim for criminal injury compensation by a certain individual. The Compensation Agency refused to disclose this information, citing section 40(2) of FOIA (personal data of third parties). The Commissioner-™s decision is that the Compensation Agency has correctly applied section 40(2) (by virtue of section 40(3)(a)(i) to the requested information. Therefore the Commissioner orders no steps to be taken. The Commissioner also finds that the Compensation Agency breached section 17(1) of the Act. Information Tribunal appeal EA/2012/0159 struck out.
