Summary: The complainant requested copies of correspondence between the Financial Services Authority (-FSA-) and the Skipton Building Society concerning the raising of interest rates for some if its mortgage holders above a guaranteed maximum. The FSA withheld information under sections 40(2), 43(2) and 44. The Commissioner-s decision is that FSA has correctly applied sections 40(2), 43(2) and 44 to the information that it has withheld. The Commissioner does not therefore require the FSA to take any further steps to ensure compliance with the legislation. This decision notice is currently under appeal to the Information Tribunal.
