Summary: The complainant has requested information relating to a transcript of a hearing carried out by the Health Care Professions Council (HCPC). The Commissioner notes that the Health Professions Council changed its name to the Health Care Professions Council on 1 August 2012. This decision notice with therefore refer to the Health Care Professions Council (HCPC) throughout for consistency. The Commissioner-™s decision is that the HCPC has incorrectly applied section 14 of the FOIA. However the Commissioner has also considered section 1 of the FOIA with regard to whether the information requested is held by the HCPC. He is satisfied that this information is not held and therefore the HCPC has complied with section 1(1)(a). The Commissioner does not require the public authority to take any steps.
