Summary: The complainant has requested information concerning a radio broadcast on 16 February 2006, which was repeated on 18 February 2006; details of new procedures in respect of the BBC-™s complaints process; and matters arising from a complaint made by him to the BBC about the broadcast. The BBC explained the information was covered by the derogation and excluded from the FOIA. The Commissioner-™s decision is that this information is held by the BBC for the purposes of -˜journalism, art or literature-™ and does not fall inside FOIA. He therefore upholds the BBC-™s position and requires no remedial steps to be taken in this case. Information Tribunal appeal EA/2012/0258 struck out.
